Yang Medical Services, PLLC dba Doctoroo welcomes you to download our mobile application software. By downloading and using the application, you agree to be bound by the terms of service set out below. If you disclose to us any information relating to receiving a referral for medical services for other people in connection with the application or website, you represent that you have the authority to do so and to permit us to use such information in accordance with the terms of service agreement.

 

Please read the terms of service carefully before using the application. If you do not agree to all the terms of this agreement, do not use the application. Doctoroo may revise and update this agreement at any time. Your continued use of the application will mean you accept the revised or updated agreement.

Our Services; Registration and Accounts

Thank you for downloading Doctoroo’s mobile application. Doctoroo provides mobile onsite treatment for simple to complex medical cases. Our skilled and licensed physicians, physicians’assistants and/or nurse practitioners (“Providers”) have substantialexperience evaluating acute injuries and illness and are equipped with the tools necessary to provide advanced medical care on demand.

When the application is accessed through a mobile device, the application is designed to enable you to send a request for non-emergency medical services. Upon submitting a request for treatment, a Doctoroo medical receptionist will contact you by telephone. After an appointment is scheduled,a Provider will be dispatched to your location; provided, however, that the Provider may, in his or her best medical judgment, based on information received through the application, medical receptionist, during the telephone consultation or in-home consultation, determine that he or she is unable to provide treatment. Doctoroo makes no representation or warranty to you that a Provider will be available to perform the medical services.

If you are using the application to schedule an appointment for a minor, you must be present during the Provider’s visit with the minor and you are responsible for payment for the medical services provided the minor, and are assuming the obligations of this agreement as they relate to the minor.

In order to use the application, you must provide us with certain personal information, including your name, address, email address, telephone number, date of birth, and any insurance information to create a user account. We may require you to take additional steps to confirm ownership of your mobile device, including requiring you to enter a verification code in the application, which we will deliver to your mobile device. You acknowledge and agree that Doctoroo may leave voicemails requesting a callback regarding your request for medical services or confirming that a Health Care Professional is on the way to your location for your appointment at any phone number provided by you, unless you communicate otherwise to Doctoroo in writing. Our Privacy Policy is expressly incorporated into this agreement by this reference.

Your Use of the Application

It is imperative that you provide accurate and truthful information about your identity and your health during the registration process. By submitting the information request to create an account, you represent and warrant to Doctoroo that all the personal information you provide during this process is true. You acknowledge and agree that we are always entitled to verify the information provided. Doctoroo reserves the right to refuse or cancel your account or your use of the application and/or the medical services at any time for any reason, or no reason at all. By accessing or using the application, you further agree that: You will only use the application or its content for your sole, personal use, you will not upload or transmit any communications or content of any type that violates any rights of any party; you will not use the application as a means to distribute advertising or unsolicited material to any third party; you will not impersonate another person; you will comply with all applicable third party terms of agreement when using the application; you will not harm the application or impair the proper operation of the network in any way whatsoever; you will provide us with whatever proof of identity we may request; you will not use another person’s account or log in credentials to access the application.
We reserve the right to immediately terminate your use of the application should you fail to comply with any of the foregoing rules.

Eligibility

You must be 18 years of age or older to use the application and any services provided through the application. If you are requesting medical services for a minor, you must verify that you are the parent, guardian or other adult responsible for the minor. By using the application, you represent that you are at least 18 years of age or are the parent, guardian or other adult responsible for a minor.

Payment
There is no charge to download the application on your mobile device. You are charged only when you use the medical services by scheduling an in-home consultation with one of our Providers. We also reserve the right to charge a reasonable fee for any cancelled appointment. Doctoroo will bill your insurance carrier (as applicable) for the medical services you receive.

Should your medical insurance (as applicable) not cover the services provided, you are solely responsible for the full cost of the medical services.
Please note that message rates, voice, and data charges from your cellular service provider may apply to access and use of the application, sending and receiving text. You are solely responsible for such message rates, voice, and data charges.

Modifications to, or Discontinuation of, the Application
We reserve the right to modify or discontinue, temporarily or permanently, the application, or any portion thereof, with or without notice.

Account Security

You are responsible for maintaining the confidentiality of your username and password that you use during the account registration process and you are fully responsible for all activities that occur under your username and password. Doctoroo will not be liable for any loss or damage arising from your failure to comply with this provision. You should use caution when accessing your account from an unsecured public or shared computer. You have been informed of the risks of transmitting your personal information through an unsecured means. Once information is received, Doctoroo uses standard methods to secure your personal information in accordance with applicable law and Doctoroo’s Privacy Policy.

Application License and Limitations on Use

Subject to your compliance with the terms and conditions of this agreement, Doctoroo allows you to download and install a copy of the application on a mobile device that you own or control and to run such copy of the application solely for your own personal use.

You shall not: license, sell, transfer, assign, distribute or otherwise commercially exploit the application in any way, reverse engineer or access the application in order to design a competitive product, or build a product using similar ideas, features, or graphics of the application, copy any ideas, features, or functions or application, launch an automated program or script, including, but not limited to, viruses or worms, or any program which may make multiple server requests per second, or unduly burdens or hinders the operation and/or performance of the application.

The application, including the content, design, organization, compilation, the source, object and HTML code and all other protectable intellectual property available through and/or comprising the application are the sole property of Doctoroo or of our licensors and are protected by copyright and other intellectual property laws.

By using the application, you agree that your use: will be for lawful purposes only and never for sending or storing unlawful material or use for fraudulent purposes; agree use will be for personal use and will not impair the operation of the network.

Intellectual Property Ownership

Doctoroo owns all rights, title, and interest, including intellectual property rights, in the application. Any copy or modification of the application shall be made exclusively by Doctoroo and/or, Doctoroo’s third-party vendors. Doctoroo’s name, logo and the product names and logos associated with the application are trademarks of Doctoroo, and no right or license is granted to you to use them.

Account Holder Conduct

Doctoroo reserves the right to terminate your account if you misuse the application or our website. You may not: upload or transmit any content or materials that are unlawful, harmful, threatening, abusive, harassing, invasive of another’s privacy, or otherwise objectionable. You may not impersonate any person, including another account holder. You may not transmit through the application content that could be characterized as medical advice. You may not interfere with our servers or networks. You may not solicit or post personal data via the application.

Medical Disclaimers

By using Doctoroo’s services, you understand that our medical services are not to be used to replace an emergency room or in lieu of calling 911 for emergencies. If you believe you are experiencing a medical emergency, please call 911 or go to the nearest emergency room.

Disclaimer of Warranties

You agree that use of the application and our website is at your own risk.
Doctoroo does not make any representations regarding the use of the content and materials provided on the application or website. Doctoroo does not guarantee that files that may be available for download through the Application will be free of viruses. You download and use the application at your own discretion and risk and are solely responsible for any damages to your mobile device or loss of data that results from the download or use of the application.

Right to Use Provided Content

We may permit you to submit content and other materials through the application. You grant us, and anyone authorized by us, the right to identify you as the author of any User-Provided Content submitted by you. Any use by you of the User-Provided Content is entirely at your own risk.
You agree to hold harmless Doctoroo and each of its directors, officers, managers, employees, shareholders from and against any and all losses, expenses, damages and costs, including reasonable attorneys’ fees, that arise out of any User-Provided Content posted or transmitted through the application by you or by others using your account.

 

Indemnification

You agree to hold harmless Doctoroo and each of its and respective officers, directors, managers, employees, and shareholders from any liabilities, penalties, claims, causes of action, and demands brought by third parties arising, or relating to: your use of the application or our website. Your agreement to defend and to hold Doctoroo harmless applies whether a claim against Doctoroo is based in contract and regardless of the form of action, including but not limited to your violation of any third party right, a claim that the application and/or our website caused damage to you or to any third party and/or your use and access to the application and/or our website.

Third Party Web Sites, Products and Services

The application and/or our website may link to or promote websites or products provided by other companies. You agree that Doctoroo is not responsible for the content and use of these websites or products. Your use of a third-party product, service or website will be subject to such third party’s terms of use, privacy policy and any other applicable terms and conditions.

Alerts

Doctoroo may provide automatic alerts and voluntary account-related alerts via email, SMS, or mobile device notifications. You may choose to have alerts sent to a mobile device that accepts text messages, which may be subject to additional message and data rates from your mobile service carrier. To opt-out of receiving alerts via text message, follow the instructions provided within the text communication. To opt-out of receiving email notifications you should follow the unsubscribe instructions in the email you receive.

Governing Law and Choice of Forum

This agreement contains the entire agreement between Doctoroo regarding your use of the application and website. No amendments or modifications to this agreement shall be valid unless in writing and signed by all applicable parties. Doctoroo may discontinue or change the application and/or website at any time. You agree that this agreement will be governed by and construed in accordance with the laws of the State of Nevada, United States of America applicable to contracts made entirely within Nevada, without regard to any conflict or choice of law principles. The exclusive jurisdiction and venue for any litigation arising out of this agreement or application will be an appropriate federal or state court located in Las Vegas, Nevada.
